Wouldn't 40MPH winds make it a storm already (subtropical?)?

The wind speed isn't enough; there have been plenty of 45-50 mph tropical disturbances. The NHC would need to confirm a closed circulation and that the storm is in fact tropical/subtropical and not extratropical before starting to issue advisories.
